MR LAMEY: Chairperson, may I just make sure whether you have before you the supplementary affidavit of Mr Bosch. I don't think that has been accorded an exhibit number.

CHAIRPERSON: Didn't we give it a page number, 49(a)?

MR LAX: Yes, yes we did.

MR LAMEY: As it pleases you, Chairperson.

CHAIRPERSON: That it should thereafter be considered as following after the original page 49 and be part of the first bundle, which was an amplification of what he had said in paragraph 21 on page 48 and a correction as to the locality.

MR LAMEY: As it please you, Chairperson.

EXAMINATION BY MR LAMEY: Mr Bosch, you have applied for amongst others, for your involvement in the operation during which there was a shooting in Vosloorus and certain MK members or an MK member that was then known as MK Valdez died after the shooting.

MR BOSCH: That is correct, Mr Chairperson.

MR LAMEY: In the bundle in front of the Committee on page 37 and 38, we find the prescribed form and is it correct that you personally filled in this form?

MR BOSCH: That is correct, yes.

MR LAMEY: And then as annexure, there's a short reference to various paragraphs, where you described incidents for which you apply for amnesty. And then on page 81 you talk about an incident in Secunda where a person was shot in the leg and then killed later. You then refer to MK Valdez page 88?

MR BOSCH: Yes, that is correct, he bled to death.

MR LAMEY: Very well. Is it also correct that in order to provide more information to the Committee for the purpose of this hearing, that a further statement was issued and was then signed by you under oath and this then referred to document 49(A)?

MR BOSCH: That is correct, Mr Chairperson.

MR LAMEY: Do you confirm the correctness of the content thereof?

MR BOSCH: Yes, I do, Mr Chairperson.

MR LAMEY: And in this hearing you also heard the oral evidence of Mr de Kock and you also had insight in his application?

MR BOSCH: That is correct.

MR LAMEY: And do you reconcile yourself with his version?

MR BOSCH: Yes I do.

MR LAMEY: For the purpose of or what happened in this, can you just tell the Committee, what was your rank at that stage?

MR BOSCH: I was a Sergeant.

MR LAMEY: You were also a member of Vlakplaas.

MR BOSCH: Yes, that is correct.

MR LAMEY: Under the command of Mr de Kock?

MR BOSCH: That is correct.

MR LAMEY: Did you at any stage personally partake in the assault of MK Valdez?

MR BOSCH: No.

MR LAMEY: Were you in the vicinity?

MR BOSCH: Yes, I was.

MR LAMEY: Chairperson, unless there is anything else, that is the evidence in chief from this applicant, thank you.

MR SIBANYONI: I've got no questions, Chairperson.

MR LAX: Just bear with me a short moment Chair, I want to just check something. Just one thing, Mr Bosch, you say in your affidavit that you knew that this man was assaulted. How did you know that?

MR BOSCH: Mr Chairperson, the truck's door was open so you could see in.

MR LAX: And obviously anyone else standing around would have seen that?

MR BOSCH: That is correct, Mr Chairperson.

CHAIRPERSON: Have you finished?

MR LAX: Yes.

CHAIRPERSON: One matter which I don't want to investigate in any way at this hearing, I just want to confirm it. If you look at page 47 - have you got your original application? Paragraph 18.

MR BOSCH: Yes, Chairperson.

CHAIRPERSON: Did you benefit in any way through these false claims?

MR BOSCH: No, Mr Chairperson.

CHAIRPERSON: Now did you stay on the scene or did you go with Mr de Kock and others?

MR BOSCH: Mr Chairperson, we went with Mr de Kock to go and look for the weapons.

CHAIRPERSON: And that was after he had taken part in this questioning?

MR BOSCH: That is correct, Mr Chairperson.

CHAIRPERSON: Thank you.
