DECISION

This is an application for amnesty in terms of the provisions of Section 18 of the Promotion of National Unity and Reconciliation Act No. 34 of 1995 ("the Act"). The application form refers to two incidents namely the offence of high treason for which Applicant was sentenced in the Pretoria Supreme Court on 20 October 1983 to 18 years imprisonment and the storage and distribution of illegal weaponry during or about the period 1991 until 1993.
Various attempts to obtain further particulars, particularly in respect of the offences committed during the period 1991 to 1993 proved unsuccessful. The necessary corroboration was obtained in respect of the matter of high treason. No useful purpose would be served by prolonging the application any further and the matter will accordingly be decided on the papers as they presently are.
In view of the fact that Applicant has failed to furnish the necessary particulars in respect of the offences alleged committed during the period 1991 until 1993, the application for amnesty is REFUSED in respect of this incident on the basis of Applicant's failure to make a full disclosure as required by the Act.
Having considered the matter in respect of the offence of high treason, we are satisfied that the offence in question constitutes and act associated with a political objective as envisaged by the Act and that the application in respect of this incident complies with all of the other requirements of the Act. In the circumstances amnesty is hereby GRANTED to the Applicant in respect of the offence of high treason in respect whereof Applicant was convicted in the Pretoria Supreme Court and sentenced on 20 October 1983.
