DECISION
The Applicant applies for amnesty in terms of the provisions of Section 18 of the Promotion of National Unity and Reconciliation Act, No 34 of 1995 ("the Act") in respect of the following:
1. a series of unlawful entries (trespassing) into the offices of the South African Bishops conference at Khanya House, Pretoria during the period December 1982 - December 1984 with the intention to make copies and/or steal certain documents;
2. a series of unlawful entries (trespassing) into the offices of members of the faculty of theology in the University of South Africa in Pretoria during the period January 1983 - December 1984 with the intention to steal and/or make copies of certain documents.
At the same time of the incidents the Applicant was a member of the Security Branch of the South African Police. All the actions and offences set out above were related to the gathering of information to assist in countering the activities of political activists.
The Committee is satisfied that the Applicant has complied with all the requirements for amnesty, that the offences committed were offences associated with a political objective within the context of the conflict of the past and that he has made a full disclosure of all relevant facts as required by the Act.
Accordingly the Applicant is GRANTED amnesty:
1. for all offences directly associated with the unlawful entries (trespassing) into the offices of the South African Bishops' Conference at Khanya House, Pretoria during the period December 1982 - December 1984 with the intention to make copies and/or steal certain documents;
2. for all offences directly associated with the unlawful entries (trespassing) into the offices of members of the faculty of theology in the University of South Africa in Pretoria during the period January 1983 - December 1984 to steal and/or make copies of certain documents.
