Type AMNESTY DECISIONS

Names GERHARDUS CORNELIUS BEESLAAR

Matter AM5640/97

Decision GRANTED

DECISION

The Applicant applied for amnesty in respect of his participation in the bombing of Cosatu House.  His application was not included in the original bundles prepared for submission to the Committee but he appeared at the hearing where his application was made available.  He gave evidence that as a member of the Police Force he was acting under the orders of Colonel De Kock.  He took no part in the explosion itself but was one of those patrolling the area to ensure that innocent passers-by were not injured.

It was the intention of the Committee that he be included in those granted amnesty.  However, when the decision was typed out it appears that the heading used was that of the original bundles.  As a result of this the present Applicant's name was omitted and no order was made granting him amnesty.

To correct this mistake we refer to the original decision and state that the present Applicant, Gerhardus Cornelius Beeslaar, falls under the description of Applicants in that decision and he is accordingly GRANTED amnesty as were those Applicants;  that is in respect of the following offences:

-     The malicious damage to the property known as Cosatu House on the 7th May 1987

-     the unlawful possession of arms, ammunition and explosives for the purpose of committing the offences referred to above

-     defeating the ends of justice by inter alia covering up the nature and cause of the explosion at Cosatu House

-     any other offence or delict directly or indirectly flowing from the acts and omission to act in respect of the explosion caused at Cosatu House.

DATED AT CAPE TOWN THIS    DAY OF                  2001.
