DECISION

The applicant, at all times material hereto, was a member of the African National Congress (the ANC) and Umkhonto weSizwe (MK).

From 1986 he was involved in intelligence gathering. He conducted surveillance and other acts of reconnaissance in respect of military installations, camps and bases throughout the country. He passed on information gathered in this way to his commanders in MK for use, at their discretion, to further the aims and objectives of MK.

He was also, from 1987, involved in the transport of weapons of war from both Botswana and Zimbabwe into South Africa.

He, at all times, acted under the general Command of his commanders, Ronnie Kasrils and Aboobaker Ismail.

We are satisfied that the applicant acted with a political objective and with the intention to further the aims of the ANC in its struggle against the government.

The applicant is accordingly GRANTED amnesty in respect of the gathering of intelligence and passing information on to MK and the unlawful possession, transportation and handling of weapons of war.
