DECISION

The Applicant, at all times material hereto, was a member of the African National Congress (the ANC) and Umkhonto weSizwe (MK).

He was, inter alia, actively involved in the smuggling of arms and other weapons into the country and then distributing the same to various dead letter boxes. He would collect weapons at Pietersburg, which were brought into the country by a busdriver who drove his bus between South Africa and Zimbabwe. He would then store the weapons at his sister's house in Zebedelia and from there distribute them to hiding places in or near Zebedelia, Nylstroom, Hammanskraal and Bronkhorstspruit. He would then send maps which indicated the hiding places to his command in Zimbabwe. The weapons handled by the Applicant were to be used by operatives of MK in the struggle against the government.

The Applicant operated in this manner during the period 1986 to 1990.

We are satisfied that the Applicant at all times acted with a political objective as envisaged by the provisions of Section 20 of the Promotion of National Unity and Reconciliation Act, No.34 of 1995. We are also satisfied that he has made a full disclosure of all relevant facts.

The Applicant is accordingly GRANTED AMNESTY in respect of the unlawful possession, handling and distribution of firearms, explosives and other weapons of war during the period 1986 to 1990.
