DECISION

The Applicant previously appeared before the Committee and testified in support of one of the incidents which formed the subject matter of his application for amnesty.  The remaining incident is presently being dealt with in chambers.  It relates to an arson attack on 12 October 1988 on Khanya House, Pretoria which was the headquarters of the Southern African Catholic Bishop's Conference.  Applicant indicated in his written application that he acted on the instructions of his immediate commander, Colonel Eugene De Kock.  The latter and a number of other members of the erstwhile security branch had appeared at a public hearing of the Committee in regard to their applications for amnesty in respect of the same incident.  Those matters had already been finalised.  It is clear from these applications that the incident constitutes an act associated with a political objective as envisaged in the Promotion of National Unity and Reconciliation Act, No. 34 of 1995 ("the Act").  This was indeed the finding of the Committee in respect of the applications already finalised.

In the circumstances, we are satisfied that the application complies with all of the requirements of the Act and amnesty is accordingly hereby GRANTED to the Applicant in respect of all offences and delicts directly resulting from an arson attack on Khanya House, Pretoria on 12 October 1988.
