TRUTH AND RECONCILIATION COMMISSIONRECONCILIATION COMMISSION

AMNESTY COMMITTEE

APPLICATION IN TERMS OF SECTION 18 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, NO.34 OF 1995.

CUNNINGHAM THOZAMILE NGCUKANA APPLICANT

(AM 7064/97)

DECISION

The applicant was a member of the underground structures of the Pan Africanist Congress of Azania ("PAC") and its military wing, the Azanian People’s Liberation Army (APLA"). Between 1980 and 1990 he recruited youths for military training and harboured trained cadres of APLA who had been infiltrated into the country.

At all times material hereto he acted in his capacity as an underground organiser and one of the internal leaders of the PAC, and acted within the scope of his duties as such,

Although he has never been arrested and charged for the offences of furthering the aims of a banned organisation and harbouring trained cadres, he is now seeking amnesty in respect thereof.

After considering the information before the Committee, we are satisfied that the applicant is entitled to amnesty for the said offences. He has shown that the offences committed were acts associated with a political objective and has compiled with the requirements of the Act.

Amnesty is accordingly GRANTED.

Signed at Cape Town on this the 17 day of September 1999
