decisions AMNESTY DECISIONS 1998-11-02 ABRAHAM YOUNG AC/98/0084 AM 2275/96 GRANTED https://sabctrc.saha.org.za/hearing.php?id=58643&t=&tab=hearings https://sabctrc.saha.org.za/originals/decisions/1998/981102_young.htm DECISION The applicant applies for amnesty in respect of: 1. contravention of Section 27(1) read with Section 27(1)(c) and Section (1) and Section 29 of Act 26 of 1956 in causing an explosion and thereby endangering property; 2. contravention of Section (1)A(i) read with Section (1)A(iii) of Act 72 of 1982 in respect of intimidation; 3. contravention of Section 7(5) read with Section 10 of Act 26 of 1956 and Section 156 of Act 51 of 1977 for being in illegal possession of explosives; 4. the stealing of a motor vehicle to be used in the carrying out of political offences. All of the above charges related to an explosion caused at the shop of a certain Hepburn near Patensie on or about the 3rd of January. The Committee after considering the application, the relevant documentation and the evidence, is satisfied that : a) the application complies with the requirements of Act 34 of 1995; b) the acts, omission or offences to which the application relates are acts associated with a political objective committed in the course of the conflicts of the past; c) that the relevant facts relating to the particular offences have been disclosed; d) that the offence does not constitute a gross violation of human rights. Amnesty is GRANTED in respect of the offences mentioned under 1, 2, 3 and 4 above. SIGNED ON THE 2ND DAY OF NOVEMBER 1998.
