DECISION

The amnesty committee having considered the nature and context of the offence and the facts and information out in the relevant documents and application of Johannes de Beer Application No AM 2337/96 is satisfied:-

1. that the application falls within the ambit of section 19(3)(b) of Act 34 of 1995

2. that the requirements set out in section 20 of the act have been complied with

Amnesty is therefore GRANTED in respect of the following offences:

1. contravention of Section 2 read with sections 39 (2) and 40 of the Act 75 of 1969 for being in illegal possession of a R1 firearm in Randfontein on 7th February 1994

2. contravention of Section 36 read with Sections 39 (2) and 40 of the Act 75 of 1969 for being in illegal possession of 2092 rounds of 7,62 ammunition on the 7th February 1994 in Randfontein

3. contravention of Section 2 read with sections 39 (2) and 40 of the Act 75 of 1969 for being in illegal possession of a shotgun on the aforementioned date and place.

4. contravention of Section 5 read with Section 1,5 (2) and 28 of the Act 26 of 1956 for being in illegal possession of a 28 meter cordtex, 3 Duraface fuses of 34cm, 36cm and 40cm, 2 Durafuse case fuses of 2,4cm, 5 Energex Pillow Packs, 4 22X200mm Powergell explosive cartridges, detonators and Pick and pay bag containing Powergell and 256cm Duracord fuse on the 2nd

5. February 1994 at Randfontein

6. for being in possession of and illegal R1 gun during the period April to November 1993 having stolen the said gun from Johan Coetzee in Benoni

7. for the theft of the explosives described in paragraph 4 above during February 1994 from the Randfontein Estates Goldmine.
