DECISION

The applicant applies for amnesty in respect of the killing of Thozamile Ntoni at Noupoort on 4 April 1993. The applicant was convicted of murder on 26 May 1995 and sentenced to 5 (five) years imprisonment. He has since been released from prison.

In his application the applicant states that he was attacked in a shebeen by two ANC supporters, one of whom was the deceased because they both bore a grudge; - "We had quarrelled before - we quarrelled over a girl". In cross-examination by the evidence leader and when questioned by the Chairperson of the Committee he once again reiterated that the ANC was against him because he was a PAC supporter but that "the grudge was about the girl".

In the light of the above the Committee finds that there was no political motive for the killing as required by Section 20(1) of the Promotion of National Unity and Reconciliation Act, 34 of 1995. Accordingly, the applicant has not satisfied the requirements of Section 20(1) of the Promotion of National Reconciliation Act and the application is REFUSED.
