DECISION

The applicant applies for amnesty in respect of his role in the murder of Piet Ntuli. He was instructed by General Joubert (see application 3799/96) to supply a bomb to Captain Jaques Hechter for the purposes of killing Mr Piet Ntuli.

He also had to instruct the said Hechter how to operate and how to fix it to the car of the late Mr Ntuli. In order to do so he inspected the car of Mr Ntuli and obtained a suitable bomb from military headquarters with the assistance of General Joubert. He showed Hechter how the device should be operated and handed the bomb to Hechter. He did not participate in the actual killing.

The Committee wishes to refer to the decisions in applications 2773/96, 2776/96 and 3799/96 where the facts are fully dealt with.

The Committee, having considered the application, the relevant documentation and the evidence before it, is satisfied that the application complies with the requirements of the Act.

Amnesty is therefore GRANTED to the applicant in respect of the murder of Piet Ntuli in KwaNdebele during or about July 1986 and the following offences connected therewith:

1. Malicious damage to property;

2. Defeating the ends of justice;

3. Contravening section 2,28,29,32,36 and 39 of the Arms and Ammunition Act 75 of 1969;

4. Contravening section 2 of the Dangerous Weapons Act 71 of 1968;

5. Contravening section 3,4,5,6,9 and 27 of the Explosives Act 26 of 1956.
