But as we gained a profile of the people who killed in the name of apartheid the ANC seems to be back peddling on its participation in the amnesty process. A strong lobby in the organisation, headed by Mpumalanga premier, Matthews Phosa argues that ANC members do not have to apply for amnesty for atrocities committed in the fight against apartheid. In his bluntest statement yet on the matter Archbishop Desmond Tutu, Chairperson of the Truth Commission, this week told the Special Report that if the ANC were to officially endorse this position he saw no reason to remain on the Truth Commission. 37:33We went to the president and he said no that is not the ANC position. It is a position of someone he holds in high regard and as you say the minister of justice agrees about this, it seems. Then they must tell us what their position is. They are not the ones who have to make decisions about whether this or that is a gross human rights violation. We have been set up to do that. We have been set up to be the ones who determine whether a particular act or mission falls within the terms of reference of the Act. Otherwise, let them give themselves a general amnesty and get down with the business. Why have a charade? If that is their position then I’m not on the Commission. I mean I’m not holding pistols to any body’s head. But if that is their position then I’m not going to engage in charades. I would say I’m no longer chairperson because there is no Commission.
