: DECISION

A. Amnesty is GRANTED to Etienne Jacobus le Roux and Johan Wilhelm du Plessis in respect of the following offences attendant to and emanating rom the bomb blasts caused by them:-

1. On or about the 24th of April 1994 and at or near Breë Street, Johannesburg
(i) The murders of Jostine Makho Buthelezi; Makomene Alfred Matsepane, Goodman Dumisani Ludidi, Gloria Thoko Fani, Susan Ann Keane, Peter Lester Malcolm Ryland and an unidentified man;

(ii) The attempted murders in respect of Pieter Ruiters, Cherrie van Heerden, Frank Nyoni, Jacobus Johannes Kruger, Pretty Mhlabuthi, Richard Dladla, John Goba, Iisha Pillay, Jostinas Oupa Molotsane, Shiko David Maimela, Clarrisa Collens, Stanley Lebogong Dube and Archie Khumalo;

(iii) Malicious injury to property;

(iv) Unlawful possession of explosive devices and material in contravention of the Explosives Act, No 26 of 1956, as amended.

2. On or about the 27th of April 1994 and at or near the Johannesburg International Airport (Jan Smuts Airport as it was then known):-

(i) The attempted murders in respect of Mark Craig Mirion, Jo-Anne Des Fountain, Zacharia Monani, Walter Martin Peter, Frans Mlatlhela; Hendrik Lambert Pieterse, Percy Mosalakae Moshwetsi, Petrus Albertus Venter, Louis Stevens and Mathys Johannes van der Walt;

(ii) Malicious injury to property;

(iii) Unlawful possession of explosive devices and materials in contravention of the Explosives Act, No 26 of 1956 as amended.

B. Amnesty is GRANTED to Etienne Jacobus le Roux, Jan Bastiaan de Wet, Johannes Abrahams Vlok and Johan Wilhelm du Plessis in respect of the following offences attendant to and emanating from the bomb blast caused by them on or about the 25th of April 1994 at or near the corner of Odendaal Street and Victoria Street, Germiston:-

(i) The murders of Piet Mashinini, Phillip Nelaphi Nkosi, Mbulawa Jonathan Skosana, Lucas Shemane Bokaba, Gloria Khoza, Fickson Mlala, Mbereyeni Maracus Siminza, Paul Etere Ontory, Thulani Buthelezi and Thoko Rose Sithole;

(ii) The attempted murders in respect of Cynthia Ncikazi Dyazi, Benjamin Ngcobo, Samuel Mshicni Nkosi, Philemon Maseko, Mokgele David Somoen, Louis Johannes Albertus Taljaard, Elizabeth Zwane and Lynette Vicki Labuschagne;

(iii) Malicious injury to property;

(iv) Unlawful possession of explosive devices and materials in contravention of the Explosives Act, No 26 of 1956, as amended.

C. Amnesty is GRANTED to Johan Wilhelm du Plessis, Abraham Christoffel "Abie" Fourie, Johannes Andries "JJ" Venter, Jacobus Petrus Nel, Petrus Paulus Steyn and Gerhardus Daniel "Gert" Fourie in respect of the following offences attendant to resulting from the bomb blasts caused by them
1. On or about the 25th of April 1994 at or near the corner of Blood Street and 7th Avenue, Pretoria
(i) The murders of Joyce Baloyi, Samuel Masemola and an unidentified man;

(ii) The attempted murders of Francina Mojapelo, Samuel Nkosi, Zita Mbolekwa and Nelson Lale;

(iii) Malicious injury to property;

(iv) Unlawful possession of explosive devices and materials in contravention of the Explosives Act, No 26 of 1956 as amended.

2. On or about the 25th of April at or near the Westonaria/Carletonville Pad, Westonaria:-

(i) The attempted murders in respect of James Ncube, Alfred Dayele, Peter Mogoshe, Phillip Plaatjies and Alex Maziba;

(ii) Malicious injury to property;

(iii) Unlawful possession of explosive devices and materials in contravention of the Explosives Act, No 26 of 1956, as amended.

3. On or about the 25th of April 1994 at or near the taxi rank at the corner of Third Street and Park Street, Randfontein:-

(i) The attempted murders in respect of Khayalabo Abrey Khunja, Anna Lewaba, Enoch Modikoe, Robert Stevens, David Jooste and Maria Mphale;

(ii) Malicious injury to property;

(iii) Unlawful possession of explosive devices and materials in contravention of the Explosives Act, No 26 of 1956, as amended.

4. Amnesty is also GRANTED to them in respect of unlawful possession of explosive devices and materials at or near the Springfontein Farm in the district Koster and the Waterval Shooting Range in the vicinity of Rustenburg respectively, during the period of 22nd to 27th April 1994 in contravention of the Explosives Act, No 26 of 1956, as amended.D. Amnesty is GRANTED to Jan Bastiaan de Wet, Johannes Abraham Vlok and Johan Wilhelm du Plessis in respect of:-

(i) Unlawful possession of explosive devices at or near Koesterfontein Farm, Krugersdorp during the period 22nd to 27th April 1994 in contravention of the Explosives Act, No 26 of 1956, as amended;

(ii) Unlawful possession of explosive materials at or near Koesterfontein Farm, Krugersdorp during the period 22nd to 27th April 1994 in contravention of the Explosives Act, No 26 of 1956 as amended.

E. AMNESTY IS GRANTED to Etienne Jacobus le Roux, Jan Bastiaan de Wet and Johan Wilhelm du Plessis in respect of the theft of motor vehicle, Peugeot 305, with registration letters and numbers FXS768T, the property of Abraham Johannes Holland at or near 32 Varing Street, Homelake in the district of Randfontein on or about the 25th April 1994.
